NEW DELHI: A Delhi court on Wednesday denied bail to accused in recent BMW accident case in which senior finance ministry official Navjot Singh died. The court also issued a notice on a plea filed by Gagnpreet Makkad, the accused seeking preservation of CCTV footage of the incident. Meanwhile, her judicial custody was extended till Sept 27. Senior advocate Ramesh Gupta, appearing for the accused pointing out that the FIR was registered 10 hour later called the accident unfortunate. “It’s an unfortunate incident, 5,000 accidents happen every year and that’s also unfortunate,” he said.The senior counsel said that the woman’s children were also inside the car at the time of the accident.Gupta raised his objection to invocation of sections of culpable homicide not amounting to murder in an accident case. “When the investigating officer registered the case, he was of the view that the accused was driving in a rash and negligent manner,” he told the court.The lawyer requested the court to grant Gaganpreet Makkad bail, saying that if it is a woman, bail can be given in death sentence cases as well.Makkad, through her lawyer also asked why no action was taken against a DTC bus as the police claimed that the two-wheeler rammed into the bus after getting knocked down by the BMW. She also said that an ambulance passed the area but refused to help the victims.The prosecution, opposing the bail said that the hospital in north Delhi where the victim was taken to 19 km away from the accident spot, is owned by a relative of the accused.“Something has to be malafide if he was taken so far away.” the prosecution lawyer told the court.He also claimed that there has been tampering of evidence.
